    • PROBLEM TO BE SOLVED: To provide an optical element that is compatible with a semiconductor process, is capable of being integrated together with other semiconductor element, has independent characteristics in term of polarization, and can perform a variety of functions in a small area even when not only a light signal is not lost by light absorption but also there is not a quantum well structure.SOLUTION: The optical element according to the present invention includes: a first waveguide that extends in one direction. A second waveguide is positioned on a side surface of the first waveguide. The second waveguide includes a first conductive type semiconductor layer, a second conductive type semiconductor layer and an undoped semiconductor layer positioned between the first and second conductive type semiconductor layers, and a refractive index of the undoped semiconductor layer is greater when compared with those of the first and second conductive type semiconductor layers. A first electrode and a second electrode are respectively connected to the first conductive type semiconductor layer of the second waveguide and the second semiconductive type semiconductor layer thereof.
