    • An electrode terminal (42) is joined, via a deformation restricting member (3), to an electrode collection part (12). Spaces (15,15) are defined above/under the electrode collection part (12) between laminate seals (2,2). The deformation restricting member (3) is disposed in the vicinity of an inner wall edge of an outer jacket including a seal part (23), thereby forming a deformation restricting part (22) for restricting the deformation into a laminate film (2). In an area extending from the front of the deformation restricting member (3) to a battery element (1), the laminate film (2) is opposed to the space (15), so that the laminate film (2) can be deformed in accordance with a change of the internal pressure. When the internal pressure is reduced, the shrinkage of the laminate film (2) can be localized at a deformation allowing part (21), so that a bending stress added to an end part (24) of the seal part (23) can be reduced. In this way, there can be provided a laminate type secondary battery and battery pack thereof wherein when the laminate film is bonded to hermetically seal and accommodate the battery element, even if the expansion and shrinkage are repeated in accordance with changes of the internal pressure, the concentration of stress to the bondage part of the laminate film can be suppressed. ® KIPO & WIPO 2007
