Thereby, in the optical disk device, a tracking error signal in which influence of stray light patterns W5, W50 formed respectively by interlayer stray beam from a plurality of recording layers is excluded can be generated, then, tracking control can be accurately performed.     • PROBLEM TO BE SOLVED: To realize an optical pick up and optical disk unit which can eliminate effect of stray light of a multi layer optical disk with a simple configuration. SOLUTION: The optical disk unit is provided with an objective lens 9 for condensing optical beam on a focused recording layer of an optical disk 100 and receiving reflective beam; a condenser lens 20 for condensing the reflective beam received by the objective lens 9; and a stray light eliminating element 30 for eliminating the stray light from the reflected light beam having a boundary surface formed at a position away from a focal point by a prescribed distance where the focused light out of the reflected light beam reflected on the focused recording layer is condensed by the condenser lens 20 on the surface including the light axis of the reflected light beam condensed by the condenser lens 20, and reflecting only the stray light out of the reflected beam reflected on a non focused recording layer on the boundary surface. Accordingly only the stray light reflected on the non focused layer out of the reflected light beam reflected by the optical disk is reflected on the boundary, so that the stray light entering on the light receiving means is surely eliminated.
