The apparatus (100) further comprises a detector (130) for detecting a violation (135) of a threshold by the decision value (125) and a processor (140) for determining a first envelope border (145) between the pair of neighboring time portions when the violation (135) of the threshold is detected. The apparatus (100) further comprises a processor (150) for determining a second envelope border (155) between a different pair of neighboring time portions or at the initial time (t0) or at the final time (tn) for an envelope having the first envelope border (145) based on the violation (135) of the threshold for the other pair or based on a temporal position of the pair or the different pair in the SBR frame. The apparatus (100) further comprises a number processor (160) for establishing the number (102) of spectral envelopes (104) having the first envelope border (145) and the second envelope border (155).

    • An apparatus (500) according to an embodiment of the present invention for mixing a first frame (540-1) of a first input data stream (510-1) and a second frame (540-2) of a second input data stream (510-2) comprises a processing unit (520) adapted to generate an output frame (550), wherein the output frame (550) comprises output spectral data describing a lower part of an output spectrum up to an output cross-over frequency, and wherein the output frame further comprises output SBR-data describing a higher part of the output spectrum above the output cross-over frequency by way of energy-related values in an output time/frequency grid resolution. The processing unit (520) is further adapted such that the output spectral data corresponding to frequencies below a minimum value of cross-over frequencies of the first frame, the second frame and the output cross-over frequency is generated in a spectral domain and the output SBR-data corresponding to frequencies above a maximum value of cross-over frequencies of the first and second frames and the output cross-over frequency is processed in a SBR-domain.

The processing unit (520) is further adapted to generate the output data stream (530) by copying at least a part of an information of a corresponding spectral component of the frame of the determined data stream (510) to describe the spectral component of the output frame (550) of the output data stream (530). Further or alternatively, the control value of the frames (540) of the first input data stream (510-1) and the second input data stream (510-2) may be compared to yield a comparison result and, if the comparison result is positive, the output data stream (530) comprising an output frame (550) may be generated such that the output frame (550) comprises a control value equal to that of the first and second input data streams (510) and payload data derived from the payload data of the frames of the first and second input data streams by processing the audio data in the spectral domain.
