SOLUTION: An electrosurgical staple instrument has an end effector capable of impressing bipolar type RF energy on the tissue. The end effector has first and second bar-shaped electrodes for forming an RF circuit with the tissue. At least one of these electrodes may have a dielectric covering layer arranged on its electrodes and creating the RF circuit. This dielectric covering layer can create an electrostatic coupling circuit with the tissue by covering one of the electrodes, or can have at least one opening passage capable of forming an RF energy passage in the tissue by contacting the tissue with the electrodes by extending through the dielectric covering layer.
