    • A laser annealing phase shifter is provided to restrain effectively the attachment of particles by forming a second layer between first and third layers using an inactive gas. A laser annealing phase shifter comprises a first layer(1) with a first refractive index on a predetermined laser beam, a second layer(2) with a second refractive index on the predetermined laser beam on the first layer, a third layer(3) with the first refractive index on the second layer, a spacer, and a fine stepped portion. The spacer(4) is formed along an edge portion between the first and the third layer. The fine stepped portion(6) is formed at a first interface between the first and the second layer or at a second interface between the second and the third layer. The second layer is made of an inactive gas.
