The turbocharger is provided with an annular by-pass passage for the exhaust gas to bypass the turbine wheel. In the by-pass passage is arranged an annular by-pass valve. The bypass valve includes a stationary annular valve seat, a rotatable annular valve member disposed in the valve seat and the shaft. The valve member is disposed about the valve seat is rotatable around an axis in order to selectively vary the degree of alignment between the respective orifice of the valve seat and the valve member. The turbine includes a nozzle having a vane assembly. In one embodiment, the vane has only a fixed vane. In another embodiment, the vane assembly is provided with both the stationary vane and the variable vanes, and the variable vane is part of a rotor which rotates with the rotary valve member.
