PROBLEM TO BE SOLVED: To provide an occupant determining device capable of determining an occupant accurately. SOLUTION: At step 101, a CPU calculates a reading detection load value of a load signal of each sensor and stores it in a memory. The CPU performs occupant determining processing based on the detected load value at a step 103 when a value of a non-adult determining flag is "0". When the detected load value is smaller than an adult determining threshold and a seat belt is switched into a wear condition from a non-wear condition when comparing the execution time of a routine for determining an occupant at a previous time with a current seat belt wear condition, the CPU changes the value of the non-adult determining flag to "1". When the value of the non-adult determining flag is "1", occupant determination based on the detected load value is not performed until the wearing of the seat belt is released.
